Understanding Eviction in Pakistan
Evicting a tenant in Pakistan requires following proper legal procedures. Landlords cannot simply force tenants out โ a proper notice and, if necessary, court order must be obtained.
Valid Grounds for Eviction
- Non-payment of rent โ Consistent failure to pay rent on time
- Violation of agreement terms โ Subletting, commercial use of residential property, etc.
- Personal need โ Landlord genuinely needs the property for personal use
- Structural repairs โ Property needs major renovation that requires vacancy
- Illegal activity โ Tenant is using the property for illegal purposes
- Property damage โ Tenant is causing significant damage to the property
Step-by-Step Eviction Process
- Written Notice: Send a formal written notice to the tenant stating the grounds and giving reasonable time (30-60 days)
- Wait Period: Allow the notice period to expire
- If Tenant Refuses: File an application with the Rent Controller
- Rent Controller Hearing: Both parties present their case
- Order: If granted, the Rent Controller issues an eviction order
- Enforcement: If the tenant still refuses, seek police assistance with the court order
What Landlords Should NOT Do
- Cut off utilities (electricity, water, gas)
- Change locks while tenant is away
- Threaten or harass the tenant
- Remove tenant's belongings
- Enter the property without permission
These actions are considered illegal and can result in criminal charges against the landlord.
